Taking note of the admission by AJL that the newspaper printing press was not operating and no paper had been published for several years, the court held that the "dominant purpose for which the 'subject premises' was leased out to petitioners no longer exists," and allowed the L&DO to proceed. "In this case the finding with regard to no press activity being carried out in the premises for about ten years, misuse of land and 100% transfer of share to another company are all subject matters of four notices issued to the petitioner," noted the high court, adding that AJL had "admitted the position with regard to there being no press activity and admitted non-publication of the newspaper due to financial trouble for more than eight years. The website of the National herald newspaper indicates a digital news platform is functioning, while the notice board outside the building indicates that a weekly newspaper is being published.
