
NCLT Kolkata: Any Attachment Of Tainted Assets Of Corporate Debtor Before CIRP Commencement Would Always Be Available To Fulfill The Object Of IBC

Arvind held that Any attachment of tainted assets of a Corporate Debtor before the Corporate Insolvency Resolution Process commencement would always be available to fulfill the object and goal of the Insolvency and Bankruptcy Code, 2016. NCLT Verdict: The NCLT Kolkata allowed the CIRP application and held that any attachment of a tainted assets of the Corporate Debtor prior to the commencement of CIRP would always be available to fulfil the object and achieve the goal of IBC. The Tribunal, drawing from the NCLAT's ruling in Kiran Shah, RP of KSL and Industries Ltd vs. Enforcement Directorate, and the Delhi High Court's decision in Deputy Director of Enforcement, Delhi vs Axis Bank & Ors., highlighted the clear distinction between the IBC and PMLA. Info Systems Ltd. identical to the present instance wherein the Financial Creditor extended the loan based on the time value of money, and the Corporate Debtor defaulted on the repayment.
