HC directs State to pay compensation to man for illegal detention

Madurai Bench of the Madras High Court has directed the State to pay a compensation of ₹50,000 to a man from Dindigul district for illegal detention. Justice N. Anand Venkatesh observed that there was absolutely no explanation as to why there was a delay and the period during which the petitioner was detained clearly constituted illegal detention. The court observed that the fundamental right guaranteed under Article 21 of the constitution only uses the word ‘person.’ It does not distinguish between a good person and a bad person. It violates the fundamental right that has been given to a person under Article 21 of the constitution, the court said and directed the State to pay compensation to the petitioner.
