Magistrate Issues Summons Against Maharashtra Minister Nawab Malik On BJP Leader Mohit Bharatiya's Defamation Complaint
Live LawNawab Malik, a minister in the Maharashtra government, is in for some trouble as a Metropolitan Magistrate's court at Sewree has issued summons against him under section 204a of the CrPC in a defamation case filed by Mohit Bharatiya, a former general secretary of Bharatiya Janta Party in Mumbai. Both of Bharatiya's complaints pertain to Malik's numerous press conferences held after the Cordelia Cruise Drugs case, in which Bollywood super star Shah Rukh Khan's son Aryan Khan is one of the accused. Bharatiya, in his private complaint, filed through Advocate Faiz Merchant alleged that Malik had grossly misused his dominant position as a Cabinet Minister in the State Government "to defame him and his family with highly speculative arguments without any evidence to substantiate his alleged malicious claims." In these press conferences, Malik had accused Bharatiya of being a part of a "private army" which was working in connivance with Narcotics Control Bureau Zonal Director Sameer Wankhede.
