Judgement on cases challenging PMLA act almost ready, says SC
India TodayJustice AM Khanwilkar of the Supreme Court on Friday indicated that the judgement in the cases challenging the validity of various sections of the Prevention of Money Laundering Act would likely be pronounced in the next few days. This is significant because the PMLA judgement will address several issues concerning investigative powers, witness summoning, ED arrest and seizure, and the bail process under the PMLA. The Solicitor General had argued that out of more than 33 lakh cases registered for predicate offences under the PMLA, the ED had stepped in to investigate only 2,186 cases for investigation since 2016. This verdict will have a direct impact not only on several politically sensitive cases where political leaders, businessmen, and others have faced arrest under PMLA provisions, but will also shape how the Enforcement Directorate and other agencies will be allowed to act in any current and future cases.
