Delhi HC in Ajay Makan's PIL directs AAP Govt. to ensure that the funds for Dengue are properly utilized [Read Order]

While disposing a PIL filed by Congress Leader Ajay Makan, a two Judge Bench of Delhi High Court asked the Delhi Government to ensure that the grant-in-aid released is properly utilized by the Corporations for taking all the necessary measures for controlling and prevention of the dengue cases. A division bench of Chief Justice G Rohini and Justice Jayant Nath also directed the Government to constantly monitor the steps that are being taken by various Departments in coordination with the Committee constituted under the "National Vector Borne Disease Control Programme A preliminary objection has been raised by Standing Counsel for the Government as to the maintainability of the writ petition as a PIL contending that the Petitioner who is a former Member of Parliament and former Member of the Delhi Legislative Assembly and presently the President of Delhi Pradesh Congress Committee, has filed the petition with ulterior motive. But the Court held that " We do not wish to enter into the issue whether the petitioner is acting bona fide or not in approaching this court since we are satisfied that the cause sought to be espoused is in public interest and deserves to be taken cognizance under Article 226 of the Constitution of India".
