People are increasingly making their personal information available publically. Data Quality Principle entails that personal data should be relevant to the purposes for which they are to be used, and, to the extent necessary for those purposes, should be accurate, complete and kept up-to-date Personal data should be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes Personal data should be processed in a manner that ensures appropriate security of such data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures. The Information Technology Rules, 2011 defines personal sensitive information as Sensitive personal data or information of a person means such personal information which consists of information relating to;— password; financial information such as Bank account or credit card or debit card or other payment instrument details ; physical, physiological and mental health condition; sexual orientation; medical records and history; Biometric information; any detail relating to the above clauses as provided to body corporate for providing service; and any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise: provided that, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as sensitive personal data or information for the purposes of these rules. The Body corporate can collect sensitive personal data or information only for its lawful function and collection of information is considered necessary for that purpose. Personal data cannot be disclosed to a third party without the consent of the provider except in the following cases:- Information is shared with Government agencies mandated under the law to obtain information for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution and punishment of offences.
