HC declines to stay single judge order letting Kerala govt. acquire land from estates for landslide survivors

A Division Bench of the High Court on Thursday declined to stay a single judge’s verdict allowing the State government to take over land from the estates of Harrisons Malayalam Ltd. and Elstone Tea Estates Ltd. for establishing new townships for landslide survivors in Wayanad. The Bench comprising Chief Justice Nitin Jamdar and Justice S. Manu also adjourned to March 13 hearing on the appeals filed by the companies challenging the single judge’s order. While disposing of writ petitions filed by the companies challenging the government decision to acquire 65.41 acres from Harrison Malayalam Limited’s Nedumbala Estate in Vythiri and 78.73 acres from Elston Estate in Pulppara near the Kalpetta Bypass, the single judge had observed that the government is free to take over the properties for rehabilitation of landslide survivors in accordance with law. The single judge had also directed the State government to determine the total compensation to be awarded to the petitioners in lieu of the land to be taken over in accordance with the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
