For the past four years, I have carefully studied what has happened to the lawyers involved in the 2020 election attack. Gene Hamilton, general counsel of Stephen Miller’s America First Legal, proposes to replace the “radical Left ideologues” purportedly running the DOJ with “appointees in every office,” following a plan first outlined by Clark—whom Trump nearly appointed as attorney general at the end of his term in an attempt to sabotage the electoral vote certification—to give the president total control. Trump knows he needs government lawyers to formally endorse illegal acts he has promised, including prosecuting political enemies without cause and using the military to detain and deport immigrants without due process. Bar’s proposed suspension of Clark applies the prohibition against reckless falsity directly to government lawyers who use the authority of governmental legal departments to undermine checks and balances protecting key democratic processes. In that case, Clark makes the radical claim that federal law completely preempts the bar from enforcing rules that impede lawyers in the “exigencies of federal service” and floats the unprecedented idea that presidential immunity permits lawyers serving the president from practicing “without complying with Rules of Professional Conduct”—an argument that, the bar noted, would “attack the very idea of holding lawyers to bar standards.” In a final salvo, Clark seeks to put the entire D.C. attorney disciplinary system out of business on the novel ground that D.C. courts, as creations of Congress, may not delegate authority to the bar as a private entity.
