
Court refuses to pause proceedings against Kapil Mishra over 'poll code violation'
India TodayThe Delhi High Court on Tuesday refused to pause the trial court proceedings in a case against Delhi minister and BJP leader Kapil Mishra for alleged breach of the model code of conduct during the 2020 Assembly polls. Despite repeated requests made by Mishra's counsel during the hearing, the court refused to pause the trial court proceedings, clarifying that the trial court is free to proceed with the matter. The FIR against Mishra was registered upon the receipt of a letter dated January 24, 2020, from the office of the returning officer in Model Town constituency regarding alleged violation of the Model Code of Conduct and the Representation of People Act. The sessions court upheld the summoning order on March 7, observing the alleged statements by Mishra appear to be a brazen attempt to promote enmity on the grounds of religion by way of indirectly referring to a 'country', which unfortunately, in common parlance, was often used to denote the members of a particular religion.
