Delhi HC Sets Aside CIC Order Declaring Every Minister A Public Authority Under RTI Act [Read Orders]
The Delhi High Court has set aside ‘as not sustainable’ the order of the Central Information Commission declaring every minister a “public authority” under the Right to Information Act.Justice Vibhu Bakhru overturned the March 12, 2016, order of the CIC, by which it was declared that “the Ministers in the Union Government and all State Governments as ‘public authorities’. The Delhi High Court has set aside ‘as not sustainable’ the order of the Central Information Commission declaring every minister a “public authority” under the Right to Information Act. Justice Vibhu Bakhru overturned the March 12, 2016, order of the CIC, by which it was declared that “the Ministers in the Union Government and all State Governments as ‘public authorities’ under Section 2 of the Right to Information Act, 2005”. The court also set aside the directions issued by the CIC to the Central and state governments to provide the necessary support to each minister, including designating some officers or appointing the said officers as Public Information Officers and first appellate authorities, besides giving an official website to the ministers for suo moto disclosure of information with periodical updating as prescribed under Section 4 of the RTI Act.
