Deceased Belonged To A Particular Community Cannot Be A Justification For Any Assault: SC Frowns Upon Bombay HC's Remarks In Bail Order [Read Order]

The fact that the deceased belonged to a certain community cannot be a justification for any assault much less a murder, said the Bench The order passed by Bombay High Court during January 2017 granting bail to three persons accused had attracted a lot of criticism due to its highly problematic observations which seemed to condone the act of murder on religious hatred. While granting bail, the High Court observed :- “The fault of the deceased was only that he belonged to another religion. It also stated that the fact that the deceased belonged to a certain community cannot be a justification for any assault much less a murder. Since there was little discussion on the merits of the matter in the High Court order, the Supreme Court restored the bail applications to the files of High Court for fresh consideration.
