"Nobody Expected People Would Have To Return To Their Hometowns": Bombay HC Condones Student's Delay In Obtaining Marksheet Amid Covid-19

Live Law

The Bombay High Court allowed a student to obtain his marksheet for 12th standard improvement exam conducted in 2020 and condoned his delay in surrendering his marksheet for 12th standard exam conducted in 2019 due to the lockdown caused by COVID-19 pandemic. Surely these are matters that are sufficiently extraordinary and warrant the exercise of some appropriate discretion.” The petitioner, Sharma Aryan Rajesh, a 22-year-old engineering student, approached the court seeking direction to the MSBSHSE, to release his original Higher Secondary Certificate Improvement Examination Result Mark Sheet for the exam conducted in February/March 2020. The petitioner claimed that her request was denied since the old mark sheet had not been returned in time, and the improvement mark sheet could not now be given to him, as per the MSBSHSE. The court ordered MSBSHSE to release the necessary improved mark sheet by Friday, August 11, 2023.
