Bail to Conman Sukesh Chandrasekhar by Bombay High Court, but jail term continues

Sukesh Chandrasekhar has been granted bail by the Bombay High Court in a case in which he was arrested nine years ago. Sukesh was granted bail by the Supreme Court in March 2016 on an undertaking of depositing Rs 3.5 crore within a month from the date of his release. While seeking bail, advocate Vikram Sutaria submitted that the maximum sentence that can be imposed upon Sukesh, even if he is convicted for the offences registered against him, is seven years, while he has already spent more than seven years behind bars, so he should be released forthwith. "Even if there was no consequential formal order of the Designated Court under the Maharashtra Protection of Interest of Depositors Act, on the said date of placing Sukesh in judicial custody in the present case, this court is of the opinion that he has continued in custody in connection with the present proceedings pending before the designated court under the MPID Act, from October 9, 2017," said Justice Pitale.
