
Kerala High Court Details Procedure By Which Third Party Can File An Application For Certified Copies
Live LawThe Kerala High Court has emphasized that High Court Rules require a third-party who is seeking certified copies of any records of the proceedings other than the judgment or decree need to file a petition stating the reason for which the copy is required. The Court said that Rule 132 of the Rules of High Court of Kerala lays down that the third-party has to file an affidavit along with a duly verified petition stating the purpose for which the copy is required. The Court noted that with regards to the other application, Registry had already called for an explanation from the concerned Filing Scrutiny Officer. The Court directed the Registry to ensure proper scrutiny of petitions and applications by Filing Scrutiny Officers especially in applications which are filed as 'Bench Mark' where the copies are served to the counsel just before the matter is taken up for consideration.
