A petition has been filed in the Supreme Court challenging the constitutional validity of the various provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023 and the Bharatiya Nyaya Sanhita, 2023 which replaced the Code of Criminal Procedure, 1973 and the Indian Penal Code, 1860 with effect from July 1, The petition challenges the following provisions of BNS and BNSS. - Section 152 BNS – The petitioner argues that this provision reintroduces the offence of Sedition as contained under Section 124A of the IPC which has been kept in abeyance since the SC's order dt. Last month, Mannargudi Bar Association had filed a writ petition in the Supreme Court challenging certain provisions of the BNSS.
