Intention Appears To Be Enlightenment Of Society; No Offence: Bombay High Court On Ex-Governor Koshyari's Statements About Shivaji Maharaj

Observing that former Maharashtra Governor Bhagat Singh Koshyari’s statements were an analysis of history and the lessons to be learnt from it, the Bombay High Court dismissed a writ petition seeking criminal action against him for his statements about Chhatrapati Shivaji Maharaj, Savitribai Phule and Jyotirao Phule. The court held that the statements cannot be seen as disrespecting any person held in high esteem by members of Scheduled Castes and Scheduled Tribes. "These statements, therefore, cannot be seen, by any stretch of imagination, to be disrespectful to any great person, held in high esteem by the members of the Society in general and by the members of the Scheduled Castes and the Scheduled Tribes in particular." Section 3 provides minimum 6-months and maximum 5-year imprisonment for disrespecting any late figure held in high esteem by the members of Scheduled Castes and Scheduled Tribes.
