
NHRC Committee Members Have Political Affiliation; Procedure Not Followed In Making Report : Sibal To Calcutta High Court In Post-Poll Violence Case
Live LawA 5-judge bench of the Calcutta High Court on Monday heard the arguments on behalf of the West Bengal Police in opposition to the report submitted by the committee of the National Human Rights Commission on post-poll violence cases in the state. Senior counsel Kapil Sibal appearing on behalf of the SPs of Police referred to various provisions of the 1993 Act to argue that the NHRC committee had not followed the envisaged procedure in order to record a prima facie finding. In response the senior counsel submitted that the High Court had not set up the NHRC committee. The Committee was only a fact finding committee" In response senior counsel Sibal added, "Your Lordships then this is not a 'NHRC' report. "Your Lordships are entrusting powers to the Committee which even the NHRC does not have under the 1993 Act", the senior counsel submitted in response.
