HC upholds conviction of Riyas Aboobacker
The HinduA Division Bench of the Kerala High Court has upheld the conviction of Riyas Aboobakkar by the Ernakulam NIA court under Unlawful Activities Act in a case relating to plotting a terrorist attack in the State in 2016. The Bench, however, reduced the sentence of 10 year rigorous imprisonment to 8 years of RI. The Bench of Justice Raja Vijayaraghavan V. and Justice Jobin Sebastian while recently disposing of his appeal observed that the interest of justice shall be subserved if the sentence imposed on him for the offence under sections 38 and 39 of the UAPA is modified as eight years of rigorous imprisonment instead of 10 years RI. The court observed that it had been established that the accused was a party to criminal conspiracy to further the activities of the terrorist organisation and to garner support by migrating to IS-controlled territories.
