DMK MLA Moves SC To Direct TN Assembly Speaker To Decide On Disqualification Of 11 AIADMK MLAs

A petition has been filed before the Supreme Court, seeking a mandamus against the Speaker of the Tamil Nadu Legislative Assembly to decide the Disqualification Petition regarding 11 MLAs who had voted against Tamil Nadu Chief Minister Edappadi K. Palaniswami in 2017. It has further been averred that the Order of 14th February states there is an outer limit of three months for a decision to be taken in respect of disqualification petitions as per the case of Keisham Meghachandra Singh v. The Hon'ble Speaker Manipur Legislative Assembly & Ors. The failure of the Speaker to take even a single step towards deciding the disqualification petition flouts "not only the letter, but also the spirit of the Order of this Hon'ble Court". In Keisham Meghachandra Singh v. The Hon'ble Speaker Manipur Legislative Assembly & Ors, a bench headed by Justice R F Nariman had held that the Speaker should take a decision on disqualification within a period of three months.
