The Supreme Court has ruled that failure to plead material facts concerning alleged corrupt practice is fatal to the election petition. The appellant, Senthilbalaji, submitted before the top court that material facts and particulars regarding the alleged corrupt practices on his part, were not found in the Election Petition. “The consensus of judicial opinion is that the failure to plead material facts concerning alleged corrupt practice is fatal to the election petition,” the court added.
