LRs Of Deceased Tenant Have A Right To Re-Entry In The Building Reconstructed After Demolition : Allahabad HC [Read Order]
Live LawDismissing the petition filed by Petitioner-landlord, the Allahabad High Court upheld the order of District Collector, allowing the substitution of the Respondents as legal representatives of the deceased-tenant under Section 24 of the U.P. The question which arose before the court was whether the legal representatives of the deceased tenant were entitled to get themselves substituted to pursue the application moved by the "original tenant", seeking re-entry under Section 24 of the Act. An application for re-entry was filed by the original tenant pending which he died and his legal representatives sought to be substituted in the proceedings. The Act does not contemplate that the legal representatives of the original tenant would be allowed to continue to pursue the application for re-entry under Section 24, he added. The Respondents on the other hand contended that the words "original tenant" would include the legal representatives in view of the definition of "tenant" under Section 3 read with Sections 2 and 146 of CPC.
