SC Issues Notice On Plea By MGP Leader Seeking Directions To Goa Assembly Speaker To Decide On Disqualification Of 2 MLAs
Live LawThe Supreme Court on Monday issued notice to the Speaker of Goa Legislative Assembly on a plea filed by Maharashtrawadi Gowantak Party Leader Sudin Dhavalikar, seeking issuance of directions to the Speaker to decide disqualification petition filed against 2 defected MGP MLA's, pending since May 5, 2019.A bench of Chief Justice SA Bobde, Justices AS Bopanna & V. Ramasubramanium. The Supreme Court on Monday issued notice to the Speaker of Goa Legislative Assembly on a plea filed by Maharashtrawadi Gowantak Party Leader Sudin Dhavalikar, seeking issuance of directions to the Speaker to decide disqualification petition filed against 2 defected MGP MLA's, pending since May 5, 2019. The instant plea contends that the Speaker of the Legislative Assembly of Goa has "abandoned his jurisdiction/duty to decide disqualification petition which has been pending since May 3, 2019" and that it has been more than a year since the issue surfaced. Notably, the instant petition has been tagged with Goa Congress President Girish Chodankar's plea which has also sought restraining the 10 defected MLA's to BJP from officiating as MLA's and Ministers and that the Speaker has violated the deadline of 3 months to decide disqualification which has been set by the Supreme Court in its recent ruling pertaining to the Manipur MLA Defection issue.
