HC adjourns hearing on pleas against eviction from Munambam land

Even as the hearing on pleas against the move to evict families from the land in Munambam in the name of Waqf land was adjourned to December 17, the High Court orally observed on Tuesday that it is inclined to pass an interim order not to dispossess them till they file a civil suit or obtain an interim stay from a civil court. A Division Bench made the oral observation when a petition challenging the eviction move and also challenging certain sections of the Waqf Act came up for hearing. The petition was filed by Joseph Benny and seven others from Munambam who had purchased land from the managing committee of Farook College, Kozhikode came up for hearing. The petitioners pointed out that Section 14 of the Waqf Act which empowered the Board to declare property belonging to any trust or society as Waqf land was unconstitutional.
