India TodayThe Maharashtra government has maintained that it will register a First Information Report only after a probe by the Crime Investigation Department is completed, and only if necessary. However, the Amicus Curiae appointed by the Bombay High Court submitted on Monday that the state CID should have registered an FIR as soon as it became involved. But the moment the CID came into the picture, it should have registered the FIR," submitted Amicus Curiae Manjula Rao. The bench of Justices Revati Mohite-Dere and Neela Gokhale had appointed Rao to answer whether the state is required to register an FIR against police officers once a magistrate’s inquiry holds them accountable, or whether it can wait for reports from the CID and a commission appointed by the state government. During an earlier hearing, the state had submitted that it could not file an FIR against the police officers involved in the custodial death of Akshay Shinde solely based on the magistrate's inquiry and was waiting for the CID report.
