Why the FCC’s Plans to Gut Net Neutrality Just Might Fail
It's official: the country's top regulator of the internet wants to end net neutrality. Specifically, Federal Communications Commission chair Ajit Pai plans to repeal changes that gave the agency the authority to enforce net neutrality protections—that is, rules requiring internet service providers to treat all internet traffic equally. Although he was light on specifics, Pai made clear that he would seek to reverse an FCC decision to classify broadband internet access providers as "Title II" common carriers, putting them in the same category as traditional telephone companies. "Just this week, 22 small ISPs, each of which has about 1,000 broadband customers or fewer, told the FCC that the Title II order had affected their ability to obtain financing," Pai said. Even if Pai's attempts to undo Title II classification fail, Congress could undo the agency's authority to enforce net neutrality regulations.
