Live LawThe National Company Law Tribunal New Delhi, comprising of Shri Dharminder Singh and Shri Avinash Kumar Srivastava, while adjudicating an application filed under Section 95 of the Insolvency and Bankruptcy Code, 2016 in IDBI Bank Ltd. v Manoj Gaur., has held that invocation of personal guarantee can be done by a Security Trustee only after obtaining consent of all co-lenders under the concerned Security Trustee Agreement. A Security Trustee Agreement dated 30.04.2015 was executed between the Financial Creditor and the Corporate Debtor. It was further argued that the Financial Creditor had concealed the fact that the Security Trustee had already filed a similar application under Section 95 of IBC bearing -83/2022 titled IDBI Trusteeship Services Ltd. Further, the Personal Guarantor apprised the Bench that in the proceedings before NCLT Allahabad under Section 7 of IBC, the financial institutions that extended loans to the Corporate Debtor were: IDBI Bank Limited Union Bank of India India Infrastructure Finance Company Limited Life Insurance Corporate of India State Bank of India Canara Bank Bank of Maharashtra ICICI Bank Limited IFCI Limited The Jammu & Kashmir Bank Limited However, in the demand notice dated 09.07.2018 issued by IDBI Trusteeship Services Ltd., the names of only 4 lenders were included, i.e.
