Adjust calendar to prioritize cases pertaining to those in jail for a long time, says Bombay HC

The court has to adjust its calender/schedule in such a way that the trials which are expedited and where the accused are languishing in jail for a considerable period of time, are given priority, said Justice Bharti Dangre of the Bombay High Court while looking into a communication forwarded by a judge of a sessions court, who could not finish trial of a case within the stipulated time granted by the higher court. Back then, the high court ordered the additional sessions judge of Thane to expedite the trial and if possible, bring the trial to a logical conclusion preferably within 12 months. WHAT THE SESSIONS JUDGE SAID Recently, the additional sessions judge sent a communication to the high court stating that “on account of pandemic, only urgent matters such as bail etc. OBSERVATION OF BOMBAY HC To this, the bench of the Bombay high court said, “An explanation about the time consumed in hearing and disposing off the bail applications is projected as an excuse to justify the slow pace for disposal of the special case.” Justice Dangre said, “Judge is reminded of the fact that when the High Court has directed an expeditious disposal of the case within a stipulated period taking into account the fact that the applicant is in custody for last four years, the aforesaid reasons shall not justify the request.” “The hearing of the appeals, if necessary, can be postponed.
