Live LawThe Delhi High Court has refused to entertain a petition under Section 482 of the Code of Criminal Procedure 1973 for setting aside its own Judgment, citing the bar on review envisaged under Section 362 CrPC. Section 362 stipulates that no Court, when it has signed its Judgment or final order disposing of a case, shall alter or review the same except to correct a clerical or arithmetical error. The Court clarified that the extraordinary power under Section 482 can only be applied where there is no express provision empowering the High Court to achieve the ends of justice. For instance, in the Supreme Court case of Simrikhia v. Dolley Mukherjee, it was held that: "The inherent power under Section 482 is intended to prevent the abuse of the process of the Court and to secure ends of justice.
