Delhi-Noida DND flyway to remain toll free, rules Supreme Court

The Supreme Court on Thursday ruled that the contract awarded to the Noida Toll Bridge Company Limited for the Delhi-Noida Direct flyway was "unjust, unfair and arbitrary," declaring that the delegation of power to NTBCL to levy a toll fee was illegal. The court dismissed NTBCL’s appeal against a 2016 Allahabad High Court decision that had stopped toll collection on the DND flyway. The court stated that the agreement's language effectively ensured perpetual toll collection, enriching NTBCL at the public's expense. The court further noted that Noida Authority exceeded its powers by delegating the authority to collect toll fees to NTBCL, which was not stipulated in the concession agreement.
