Supreme Court Rejects Argument That Section 6A of Citizenship Act Violates Fraternity Concept

Live Law

The Supreme Court has ruled that Section 6A of the Citizenship Act, which allowed migrants who came to Assam from Bangladesh before March 25, 1971, to seek Indian citizenship, is constitutional. The court found that the concept of fraternity is not limited to a global/transnational construction and that it encompasses a sense of collective brotherhood among all Indians. The court also found that the influx of immigrants from Bangladesh into the State of Assam has not violated the concept of fraternity. The court's decision is expected to have a significant impact on the lives of many migrants and their families who have been struggling to obtain Indian citizenship.
