Advocate Kritika Oberoi, Delhi High Court & District Courts says, “It’s time for businesses to scrutinise and define their accountability structures to ensure the ethical and effective use of AI, a blend of both innovation and responsibility and reliability.” She explains that when it comes to AI systems, accountability usually is a delicate terrain to sail through. Advocate Kapil Naresh, Technology Lawyer and Transaction Associate at H&B Partners says, “When it comes to the question of vicarious liability in the context of AI systems, it’s essential to understand that many parts could potentially be responsible if something goes wrong.” If a developer designs an impeccable AI system but the end user fails to bear minimal responsibility in adhering to safety mea- sures, would it be right for the former to bear the brunt if things go wrong? She says, “If an AI system used in lending practices unfairly denies a loan to individuals from certain communities, it could be challenged as being discriminatory against individuals.” POSSIBLE SOLUTIONS While AI-related problems are many, one can be more cautious about reading terms and conditions when giving consent to use personal details. “Addressing legal loopholes surrounding AI requires a pragmatic approach that views machine- generated and human-generated elements as being interconnected,” says Advocate Kapil Naresh.
