Anganwadi Karyakarta Candidates Related Within Prohibited Degrees To Govt Employees Having Influence On Selection Process Are Ineligible: MP High Court
Live LawMadhya Pradesh High Court has recently held that when government employees who have direct/indirect influence in the selection process or members of local bodies are related within the prohibited degrees to an Anganwadi Karyakarta candidate, then that candidate will be held ineligible. The single-judge bench of Justice Vivek Agarwal clarified the right interpretation of Clause 4 in the memorandum and stated that direct involvement in the selection process/scrutiny process of a Karyakarta is no longer relevant for determining eligibility when the Panchayati Raj/ local body members already have a close relation with the candidate as specified in the memorandum. & Ors., a division of the Madhya Pradesh High Court refused to disqualify a candidate whose brother-in-law was a Panchayath Karmi since the relation does not come within the prohibited degrees mentioned in the memorandum. The single judge bench of Justice Vivek Agarwal, after going through the aforesaid order, noted that the first part of the ratio in Draupathi Tiwari, prohibiting the appointment of candidates with relationships that fall within the prohibited degrees, is binding upon the court.
