The Supreme Court observed on Monday that religion does not encourage polluting activities like bursting firecrackers which affect the fundamental right to health of citizens. A bench headed by Justice A.S. Oka made the remark while recording the Delhi government’s delayed move to issue a firecracker ban in the national capital two days after Dussehra, on October 14, possibly allowing sellers and enthusiasts to stockpile ahead of Deepavali. On the court’s question of imposing a perpetual, year-long ban on the sale and bursting of firecrackers, the Delhi government appeared non-committal, saying it had to consult with stakeholders. Stakeholders oppose ban “Who are these stakeholders?” Justice Oka asked the Delhi government counsel. “Anybody who claims they have a fundamental right to burst crackers and create pollution, let them come to court,” Justice Oka retorted.
