The Madurai Bench of the Madras High Court has imposed a cost of ₹10,000 on a petitioner from Thoothukudi district who sought the cancellation of patta granted to a few persons. Ramesh and A.D. Maria Clete observed that the claim of the petitioner that private parties had encroached upon the land cannot be sustained since there is a presumption drawn on the Patta Passbook Act that the entries made in the patta are true and genuine. This apart, the petitioner sought cancellation of patta of the private individuals without making them as party in the petition. Further, the court observed that the petitioner had not approached the court with clean hands and had abused the process of law by claiming the petition as a public interest litigation petition.
