
Youtuber Savukku Shankar case: Madras High Court quashes ‘Savukku’ Shankar’s detention under the Goondas Act

Further, observing that the Goondas Act could be invoked only if a person had indulged in acts prejudicial to maintenance of public order, the Bench said: “Speeches criticising the government, its policies and actions or exposing corrupt or illegal actions in public administration cannot be termed as a threat to public order.” Authoring the verdict, Justice Subramaniam also wrote: “The Government can handle the social media as an effective tool to understand the grievances of a common man instead of trying to shut him down. The soul of a healthy democracy lies in free speech.” The judges pointed out that the Commissioner of Police had passed the preventive detention order on the basis of a ground case registered against the YouTuber for having published a video on February 11, alleging corruption in award of a contract to a private firm, for maintaining a new bus stand constructed at Kilambakkam. However, in the detention order, the Commissioner had written: “Later, on February 10, 2024 the passengers at Chennai’s new Karunanidhi Centenary Bus Terminus in Kilambakkam staged a protest, alleging the non-availability of buses due to the wrong influence of the above false propagandas.” Since the protest had taken place even before the publication of the YouTube video, the judges said: “This clearly shows inconsistencies in the timeline of events thereby causing doubts in the detention order. Further, there has been clear non-application of mind on the part of the detaining authority.” In so far as two other adverse cases relied upon by the Commissioner, the judges said, both those cases had been booked on May 7, 2024, just days before the passing of the preventive detention order, and one of them had been registered for having harassed a woman journalist in 2018.
