'Non-Availability Of Public Prosecutors May Result In Violation Of Accused' Right To Speedy Trial': Karnataka High Court Directs State To Fill Vacancies

The Karnataka High Court on Friday directed the State Government to take prompt steps to fill in all vacant posts of Public Prosecutors in the state, whether by regular recruitment or on contract basis. The government also informed the court that the posts of Senior Assistant Public Prosecutors cannot be filled on contract basis, in view of an interim order passed by the Karnataka Administrative Tribunal. The court on going through the order passed by the tribunal said "There is no restraint on appointing Senior Assistant public prosecutors on contract basis. If no such prohibitory order is operating, it is obvious that subject to the outcome of pending proceedings, the state can appoint Senior Assistant Public Prosecutors on contract basis.
