Live LawFollowing the retirement of Justice CT Ravikumar of Supreme Court, the bench hearing review petitions filed against the Vijay Madanlal Choudhary judgement, which upheld various provisions of the Prevention of Money Laundering Act, is set to be reconstituted. It may be recalled that the matter was being considered by a bench of Justices Surya Kant, CT Ravikumar and Ujjal Bhuyan, but got adjourned on multiple occasions between August-November, 2024 without any effective hearing. In November, 2023, the 3-judge bench dealing with the matter - comprising Justices Sanjay Kishan Kaul, Sanjiv Khanna, and Bela M Trivedi - came to be dissolved following Justice Kaul's retirement. While issuing notice on August 25, 2022, CJI Ramana-led bench orally observed that at least two conclusions of the judgment required relook - first, that the copy of the Enforcement Case Information Report need not be given to the accused, and second, the upholding of the reversal of presumption of innocence.
