The NCLT Mumbai, in its order dated 06.10.2023, dismissed the application filed by the appellant and approved the resolution plan filed by the Resolution Professional. NCLAT Verdict The NCLT Delhi dismissed the appeal and held that appellant, being a dissatisfied homebuyer in a hopelessly minority position, has no option but to sail along or drag along with the overwhelming majority that has accepted the resolution plan.
