
Consumer Commission rap for private bank for debits on non-existent consumer loan
The HinduThe State Consumer Disputes Redressal Commission has directed a private bank to pay compensation to a customer for debiting equated monthly installments from her bank account for a non-existent loan. The order passed by S.Sundaravadivelu, Commission presiding member and S. Oumasangeury, member, held IDFC First Bank liable to pay ₹1,50,000 as compensation to the appellant, Gajalakshmi, of Moolakulam, for deficiency of service and non-adherence to RBI fair practices code. The Commission also directed the bank to reverse the amounts of ₹58,000 debited from the loan accounts of the complainant, refund any EMIs deducted till the date of this order, not deduct any further EMI and to issue a ‘no due’ certificate. The District Consumer Disputes Redressal Commission had dismissed her complaint, stating that issues involving fraud required a criminal trial rather than a consumer dispute resolution and cited lack of sufficient evidence to prove the connection between the alleged fraudsters and the opposite parties, or their role in a conspiracy to defraud.
