Reservation can't be on basis of religion: Supreme Court on West Bengal OBC case

The Supreme Court on Monday said that reservations cannot be granted on the basis of religion. The remark was made during a hearing on the West Bengal government's plea challenging the Calcutta High Court's decision to cancel the inclusion of 77 communities in the Other Backward Classes list in the state. A bench led by Justice BR Gavai made the observation after Senior Advocate Kapil Sibal argued that the High Court’s decision to strike down provisions of the Act was incorrect. “If in principle Muslims cannot get reservations is a different issue, but the High Court could not have struck down the provision of the Act itself,” Sibal submitted. Sibal informed the court that the High Court’s order had led to the cancellation of 1.2 million certificates issued to beneficiaries.
