Live LawA wife is not entitled to seek the details of the Income Tax Returns filed by her husband by filing RTI application, the Central Information Commission has observed. Information Commissioner Neeraj Kumar Gupta observed that the filing of the Income Tax Returns by an individual with the Income Tax Department is not a public activity. The Income Tax department had refused to provide the details on the ground that the Income Tax Returns of some other individual is an exempted information u/Section 8 of the RTI Act. The commissioner referred to the Supreme Court judgment in Girish Ramchandra Deshpande v. Central Information Commission in which it was held that the details disclosed by a person in his income tax returns are "personal information" which stand exempted from disclosure under clause of Section 8 of the RTI Act, unless involves a larger public interest and the Central Public Information Officer or the State Public Information Officer or the Appellate Authority is satisfied that the larger public interest justifies the disclosure of such information.
