Bombay HC allows 18-year-old to abort, says continuance of pregnancy may injure woman's health
India TodayDespite a report from the medical board that there is no mental or medical reasons warranting termination of pregnancy, the Bombay High Court allowed an 18-year-old girl to terminate an unwanted pregnancy. The court held that further continuation of pregnancy would adversely affect the girl's mental health. During an earlier hearing, the bench had directed the Grant Government Medical College and Sir J J Group of Hospitals, Mumbai to constitute a medical board for examination of the girl, including the status of her mental health due to her pregnancy and thereafter to submit a report. The Court also inferred the legislature had consciously used the word ‘mental health’ instead of mental illness in the medical termination of the Pregnancy Act.
