Mere Abuse In A Filthy Language Does Not Attract Offence Of Criminal Intimidation U/s 506 IPC: SC [Read Judgment]

The Supreme Court has observed that mere act of abusing a person in filthy language does not satisfy the ingredients of the offence of Criminal Intimidation. The bench comprising Justice Ashok Bhushan and Justice KM Joseph was concerned with an appeal filed by one Vikram Johar against the High Court and the Trial Court orders refusing to discharge him from a criminal case. Referring to Fiona Shrikhande Vs.State of Maharashtra, the bench said: "The intentional insult must be of such a degree that should provoke a person to break the public peace or to commit any other offence. In order to attract Section 506 IPC, the court, referring to Ratanlal & Dhirajlal on Law of Crimes, 27th Edition, said that the the prosecution must prove: That the accused threatened some person.
