Supreme Court Rules on Section 6A of Citizenship Act: A Historical Perspective
The HinduThe Supreme Court of India has upheld Section 6A of the Citizenship Act, 1985, which granted deemed citizenship to those who entered Assam from areas in erstwhile East Pakistan before 1966. However, the provision was struck down because it created a system of registration for immigrants from 1971 to 1976, who had to be declared foreigners by a tribunal before they could apply for citizenship. The majority of the Supreme Court judges rejected the argument that Section 6A is unconstitutional on the grounds that it treats Assam differentially from the rest of the country and that it violates the principle of fraternity in the Constitution. The decision is a significant victory for the immigrant community in Assam and will hopefully pave the way for a smooth and inclusive process to finalize a National Register of Citizens for the state.
