Explain why non-vaccinated people aren't allowed to use local trains: Bombay HC to Maha govt

The Bombay High Court has asked the Maharashtra government to explain the rationale behind non-vaccinated people not being allowed to use the Mumbai local trains. On Thursday, the court said, "Keeping in mind the broader issue of curtailment of the fundamental rights of non-vaccinated citizens to avail suburban rail services, the rationale, therefore, needs to be presented before the court either by the state government or by the State Disaster Management Authority.” The court granted Maharashtra’s chief secretary time till December 21 to file an affidavit with an explanation. THE CASE The court issued this direction to the Maharashtra government while hearing two public interest litigations against the state government’s circulars prohibiting persons who are not fully vaccinated against Covid-19 from travelling by local trains in Mumbai. They claimed that fully vaccinated persons were also capable of spreading the infection, especially with the new Omicron strain MAHARASHTRA GOVT’S ARGUMENT Senior advocate Anil Anturkar, appearing for the State of Maharashtra, argued that the Constitution provided for reasonable restrictions on the fundamental rights of every citizen.
