
Rajasthan HC Admits Plea Challenging Installation Of Petrol Pump Near Crematorium & 11,000 KV High-Tension Line, Confirms Stay Order
Live LawThe Rajasthan High Court has admitted a petition challenging installation of a Hindustan Petroleum Corporation Limited petrol pump 25 meters near a shamshan and 18 meters near a high-tension line of 11,000 KV, while confirming the order that stayed such installation, permitting HPCL to take out the motor spirit if already stored in the underground tanks. The bench of Justice Sudesh Bansal opined that it seemed like the NOCs provided by the authorities did not take into consideration the fact that the site that was approved for establishing the petrol pump was so near to a shamshan and the 11,000 KV line. In this background, the Court confirmed the stay order in relation to the installation of the petrol pump, and HPCL was directed to take out the spirit motors if already supplied and stored in the underground tanks, with the liberty to HPCL to grant any alternative location to the concerned party for such retail outlet.
